Dekang Medical Privacy Policy

1. Who we are

Dekang Medical ("Dekang", "we") provides Traditional Chinese Medicine, acupuncture, massage therapy and physiotherapy at our clinics in Mississauga and Burlington (current addresses are listed on our website). We are a health information custodian under Ontario's Personal Health Information Protection Act, 2004 (PHIPA). This policy explains how we collect, use, disclose and protect your personal information and personal health information, and how you can access your records or make a complaint.

2. What we collect

  • Identity and contact information: name, date of birth, sex, preferred language, mobile phone, email, mailing address and emergency contact.
  • Health information: reason for visit, medical history, symptoms, allergies, medications, pregnancy status, treatment notes and records of the care we provide.
  • Consent records: the consents you give or decline, your signature and the date and time.
  • Insurance and billing information: insurer, plan and member numbers, the plan holder's name and date of birth, and payment records.
  • Appointment and communication records: bookings, reminders and messages you exchange with us.
  • Website information: basic technical data needed to run our website and online booking (for example browser type and pages visited). We do not use third-party analytics or advertising trackers.

3. How we use your information

We use your information to:

  • assess you and provide, plan and coordinate your care;
  • book, confirm, remind you of and manage appointments;
  • bill you and, with your authorization, submit claims to your insurer (Direct Billing);
  • meet our legal and professional obligations, including record keeping required by our regulatory colleges;
  • run, protect and improve our clinic and services.

With your separate and optional consent, we may also use de-identified information for teaching and research, and send you news or promotions. You may withdraw these optional consents at any time; this does not affect your care.

4. Consent

By seeking care from us, you consent to our collecting, using and disclosing your health information for your care, unless you tell us otherwise. You may withhold or withdraw consent at any time, except where the law requires or permits otherwise; if this affects your care, we will explain how. For anyone other than your care team, we ask for your express consent unless the law permits disclosure without it. For patients under 16, a parent or legal guardian usually gives consent on the patient's behalf.

5. When we share information

We share your information only as needed and as permitted by law:

  • with other health care providers involved in your care, unless you tell us not to;
  • with your insurer, when you ask us to bill them directly;
  • with service providers that help us run the clinic, such as our electronic health record, appointment, text message and email systems. They may use your information only to provide their service to us and must protect it;
  • when required or permitted by law, for example to prevent serious harm or in response to a court order.

We do not sell your information.

6. Text messages and email

We send appointment confirmations, reminders and requests to complete your intake and consent forms by text message or email. With your consent we may also send news and promotions; you can reply STOP to any text message, or contact us, to stop these at any time. We do not include your health information in text messages or emails.

7. Website and online booking

When you book online or complete our online forms, your information is sent over an encrypted (HTTPS) connection and stored in our clinic systems. Links in our messages are personal to you; please do not share them. Our website does not use third-party analytics or advertising tools.

8. How we protect your information

We protect your information with physical, administrative and technical safeguards, including secure systems, passwords, access limited by job role, and records of who views or changes information. For example, practitioners see the health information they need for your care, while contact and insurance details are limited to reception and billing staff. If your information is stolen, lost or used or disclosed without authority, we will notify you and, where required, the Information and Privacy Commissioner of Ontario.

9. How long we keep records

We keep health records as long as our regulatory colleges and the law require, generally at least 10 years after your last visit, or 10 years after your 18th birthday if you were a minor when treated. We then destroy them securely. Details collected through our online forms are deleted from our booking system after they have been transferred to your health record, except for consent records and insurance information that we need to keep.

10. Access and correction

You may ask to see or receive a copy of your health record, and ask us to correct it if it is inaccurate or incomplete. Please make your request in writing to our privacy contact. We will respond within the time required by law (generally 30 days), and may charge a reasonable fee for copies as permitted by law. If we refuse a request, we will tell you why and how to complain.

12. Changes to this policy

We may update this policy from time to time. The current version is always posted on our website with its effective date. If there is any inconsistency between the English and Chinese versions, the English version prevails.

4. 同意
